Buying or Selling a Brevard Condo Under Florida's New Condo Laws
After a rough 2025, Brevard's condo market is coming back. In Q3 2026, condo and townhouse closings rose 10.6% and the median price rose 5.7% to $280,000, according to Space Coast REALTORS® data. Supply dropped from 7.6 months to 5.9 months in a year.
The biggest factor in any Brevard condo sale now isn't the view. It's the building's paperwork.
What Florida's condo laws require
After the 2021 Surfside collapse, Florida passed a series of condo safety laws. For buildings three or more stories tall:
- Milestone inspections: A licensed engineer or architect must inspect the building's structure once it reaches a set age, then every 10 years.
- Structural Integrity Reserve Study (SIRS): Associations had to complete one by December 31, 2025, or by December 31, 2026 if they're coordinating it with a milestone inspection.
- No more waived reserves: Starting with 2026 budgets, associations must fund reserves for SIRS structural items. Owners can no longer vote to skip them.
That's why some Brevard buildings raised dues or passed special assessments in 2025 and 2026. It's also why many buyers left the market last year.
Why it matters on the Space Coast
Cocoa Beach, Cape Canaveral, Satellite Beach and Indialantic have dozens of mid-rise and high-rise condo buildings built in the 1970s and 1980s. Those are exactly the buildings these laws target.
Tips for condo buyers
- Ask for the milestone inspection report, the SIRS, the current budget and any planned assessments before you write an offer.
- Compare monthly dues to what the SIRS says reserves should be. Low dues can mean a big assessment is coming.
- Remember that Florida gives condo buyers a review period after receiving the association documents.
Tips for condo sellers
- Gather the building's inspection and reserve documents before you list.
- A building with a clean inspection and funded reserves is a selling point. Lead with it.
- Price to Brevard comps. In September 2026, condos sold for a median of 94% of original list price and took about 64 days to go under contract.
